Lawsuit Alleges Copyright Infringement and Fraudulent Inducement
Former U.S. Representative George Santos has taken legal action against late-night host Jimmy Kimmel, accusing him of deceiving Santos into creating videos on the Cameo app that were later used to mock him on Kimmel’s show. The lawsuit, filed in U.S. district court in New York, lists Kimmel, ABC, and Walt Disney Co. as defendants. A representative for Disney’s Jimmy Kimmel Live! show has not yet responded to requests for comment.
Santos’ Allegations
Santos, who was expelled from the House of Representatives due to fraud and theft charges, claims that Kimmel misrepresented himself to persuade Santos into producing personalized videos that were later exploited for ridicule. The lawsuit cites copyright infringement, fraudulent inducement, breach of contract, and unjust enrichment among its claims.
Deceptive Requests
According to the complaint, Kimmel submitted at least 14 fake requests to Santos through Cameo, using false names and scenarios. These videos were subsequently featured in a show segment called “Will Santos Say It?” In one instance, Santos congratulates a fictional winner of a beef-eating contest, unknowingly playing along with Kimmel’s prank.
Legal Action and Damages
Santos’ attorney, Robert Fantone, emphasized that while Kimmel’s actions may have been amusing, they violated copyright laws. Santos is seeking $750,000 in statutory damages for the five videos that were aired on the show and various social media platforms. Additional damages will be determined during the trial.
Background on Santos
Santos faces multiple criminal charges related to fraud, including misusing campaign funds and defrauding donors. He pleaded not guilty to these charges in October. In a special election, Democrat Tom Suozzi succeeded Santos in his former congressional seat.
